Terms and Conditions
1. ABOUT US
1.1 These Terms and Conditions are issued by Via del Premio Limited, a company incorporated under the laws of Gibraltar with company number 126740 and registered office at Madison Building, Midtown, Queensway, Gibraltar, GX11 1AA ("Promoter", "we", "us", "our(s)"), which operates prize competitions and free promotional competitions on the website www.villawin.co.uk and any associated apps (the "Website") and at selected events, including events organised together with our promotional partners.
1.2 We run two types of competitions (each a "Competition" and together the "Competitions"):
(a) "Prize Competitions" – prize draws in which the outcome (and therefore the allocation of prizes) is determined by chance, and for which there is both a paid entry route and a free postal entry route for entrants to choose between (see clause 7); and
(b) "Free Competitions" – promotional prize draws in which the outcome is equally determined by chance, but which are exclusively free to enter: no Tickets are available for purchase, and entries are awarded as described in clause 8.
No purchase is necessary to enter or to win any Competition, and each entry into a Competition, however it is made or obtained, has the same chance of winning a prize as any other entry into the same Competition.

2. APPLICABILITY AND ACCEPTANCE
2.1 By using the Services (see clause 2.3 below for how ‘Services’ is defined), you are entering into a legally binding agreement with us, which is comprised of:
(a) these general terms of use (‘Terms of Use’);
(b) any rules that apply to specific Competitions that we offer, which can be found on the relevant Competition page(s) of the Website (‘Competition Rules’); and
(c) any terms that apply to specific promotional activities that we may offer (for example, refer-a-friend or free-ticket promotions), which can be found on the relevant promotion page (‘Promotional Terms’).
Together, the Terms of Use, the Competition Rules and the Promotional Terms shall be referred to as the ‘Terms and Conditions’.
2.2 We may, from time to time, organise promotional campaigns and promotional prize draws, whether alone or together with third-party promotional partners. Free Competitions are governed by clause 8 of these Terms of Use, referral programmes by clause 9 and Matchday Challenge promotions by clause 10, in each case together with the parameters stated on the relevant Competition or promotion page. Promotional activities and mechanisms – including Free Competitions, referral programmes and Matchday Challenge promotions – are available only when, and as, published on the Website; we are under no obligation to make any of them available at any particular time, and the fact that a promotional activity has been offered in the past does not create any entitlement to its repetition or continuation. The details of how any other specific promotional activity operates – including any free tickets, bonus credit, or similar – are set out on the relevant promotion page, and these Terms of Use apply to any promotional activity to the extent relevant and not inconsistent with its Promotional Terms.
2.3 The Terms and Conditions apply to you whenever you use the Website, register for an account with us, enter into any Competition, purchase any tickets to enter online Prize Competitions (‘Tickets’), receive or use any Free Entries (see clause 8 below for how ‘Free Entries’ is defined), participate in any of our promotional activities, win any prize, or otherwise use, access and/or interact with any of the products, services or functionality offered by us, which are collectively referred to as the ‘Services’.
2.4 In the event of any conflict or inconsistency between the Terms of Use, the Competition Rules and/or the Promotional Terms, the order of priority in which they shall apply will be: the Promotional Terms, then the Competition Rules, then the Terms of Use.
3. CHANGES TO THE TERMS AND CONDITIONS
3.1 We may make changes to the Terms and Conditions from time to time (for example, to comply with a change in applicable law). Where we make any material changes, we will take reasonable steps to provide notice to you in advance where reasonably possible, and we also recommend that you periodically check the Website for updates. Any changes will not apply to any entry you have already submitted, but will apply to any entry you submit after the change takes effect. If you do not agree to the changes, you must stop using the Services and you may close your account.
4. ELIGIBILITY
4.1 To enter a Competition, you must be at least 18 (eighteen) years old and located in the United Kingdom (including Northern Ireland), the Isle of Man or the Channel Islands. By registering an account and entering, you confirm that you meet these requirements. We may carry out age, identity and eligibility checks at any time, and may require you to provide documentary evidence of your age, identity and eligibility before a prize is awarded.
4.2 No employee, officer, director, consultant, contractor or agent of the Promoter or of any company within the Promoter’s group, nor any member of their household, may enter or participate in any Competition, whether directly or indirectly. Any entry made in breach of this clause shall be invalid.
4.3 By using the Services, you confirm that you are not breaching any laws in your country of residence or in any jurisdiction from which you access and use the Services. If in any doubt, you should immediately cease using the Services and check with the relevant authorities. We will not be held responsible nor accept any liability for your unlawful use of the Services.
4.4 If we become aware that you have entered in breach of any of the eligibility criteria above, we will revoke your participation in any and all Competitions, and any prizes, Tickets, Free Entries or other entries associated with your account will be void.
5. YOUR ACCOUNT
5.1 In order to enter a Competition, you must register an account with us using a valid email address or a social media account (such as Facebook, Google or Apple). You must provide accurate and complete information (including your name, address, date of birth and telephone number) and keep it up to date. It is your sole responsibility to ensure that your contact details are recorded correctly, and we will not be held responsible if you record them incorrectly.
5.2 You may register only 1 (one) account, which must be for your own personal use and not for the benefit of any third party. You are responsible for keeping your login details secure and for all activity that occurs under your account. You have the right to close your account at any time.
5.3 We may suspend, restrict or close your account, invalidate Tickets or Free Entries, or withhold or void prizes where we reasonably believe that you have breached the Terms and Conditions, abused the Services or other customers or staff, or that the entries are not genuinely being made by you, or where we otherwise consider it necessary to ensure the fair treatment of customers or the integrity of our Competitions. Any action we take under this clause will be proportionate.
5.4 We provide a range of tools to help you manage your participation in our Competitions. Details of the available tools can be found in our Mindful Play Policy on the Website, and include the ability to set spending limits (including a limit of £0) from your first purchase, to take a break, and to suspend or close your account.
5.5 If you do not log in to your account for a continuous period of 12 (twelve) months, your account will be deemed inactive. We will take reasonable steps to notify you at your registered email address before your account becomes inactive. Once your account is inactive, any unused Free Entries and other promotional benefits associated with it will lapse and be void; entries already submitted into a Competition that has not yet been drawn are not affected. We may subsequently archive an inactive account, and we will retain and delete the personal data associated with it in accordance with our Privacy Policy.
5.6 We may, at our discretion and on reasonable grounds, suspend or restrict an account, or decline entries, where we consider this necessary to protect a customer or to ensure the fair treatment of customers, including where information available to us indicates that continued participation could reasonably be expected to cause harm or to impair informed decision-making. Any action we take under this clause will be proportionate, and nothing in this clause imposes an obligation on us to monitor or assess individual circumstances.
5.7 From time to time, we may offer a promotional account status (for example, 'Founder' status) to customers who meet the qualifying conditions stated on the relevant promotion page, such as registering an account by a stated date. The benefits attached to a status and its qualifying conditions are those stated on the relevant promotion page. Unless the relevant promotion page states otherwise, a status and the core benefits stated there are granted for the lifetime of your account: they remain attached to your account for as long as your account remains active, and they lapse when your account becomes inactive or is closed by you or by us in accordance with these Terms of Use. Where we describe a status or a benefit as 'lifetime', this refers to the life of your account, not to your lifetime. A status is personal to your account, is non-transferable, has no monetary value and cannot be exchanged for cash. We may add further benefits to a status from time to time, and may vary or withdraw an additional benefit on reasonable notice, but we will not reduce the core benefits stated on the promotion page at the time you qualified while your account remains open. A status does not affect your chances of winning any Competition or the operation of the free entry routes described in these Terms of Use.
6. USE OF THE SERVICES AND INTELLECTUAL PROPERTY
6.1 Subject to your compliance with the Terms and Conditions, we grant you a limited, revocable, personal, non-transferable and non-exclusive licence to use the Services for your own personal, non-commercial use. You must not, and must not permit or assist any other person to, copy, modify, reverse engineer or create derivative works based on the Services, or sell, sub-licence or otherwise commercially exploit them.
6.2 The Services, and all text, graphics, images, photographs, video and other content contained in them, together with all intellectual property rights in the Services, are owned by us or our licensors and are protected by law. You may not copy, reproduce or modify them, in whole or in part, without our prior written consent.
6.3 We use certain third-party tools to deliver and display promotional campaigns, offers and rewards (including Free Entries). Ad-blocking or similar content-blocking software or settings on your device may prevent promotional offers, rewards, Free Entries or related communications from being displayed, delivered or credited to you, and may restrict some features of the Website. We recommend that you disable or adjust any such software for the best experience of the Services. To the fullest extent permitted by applicable law, we will not be responsible where you do not receive, or cannot benefit from, any promotional offer, reward, Free Entry or communication, or where a feature of the Website is restricted, as a result of any such software or settings.
7. ENTERING A PRIZE COMPETITION
General
7.1 We may operate one or more Prize Competitions at the same time, each with its own prize, Ticket price, maximum number of available Tickets, and maximum number of entries permitted per person, as specified on the relevant Competition page on the Website. The maximum number of entries per person applies regardless of how those entries are obtained.
7.2 You have a choice of whether to participate in a Prize Competition by paying for one or more Tickets online, or free of charge by post (see ‘Free Postal Entry’ below). Whichever route you choose, each entry has the same chance per entry of winning a prize.
7.3 We reserve the right to refuse or disqualify any incomplete entry, or any entry where we have reasonable grounds to believe that you have committed a material breach of the Terms and Conditions, in which case the entry will be forfeited and no refund will be due. To the fullest extent permitted by applicable law, all entries become our property and will not be returned. For the avoidance of doubt, only the Ticket or entry recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant Competition.
Paid online entry
7.4 To enter online, follow the on-screen instructions to select the Prize Competition, provide your contact and payment details, confirm that you have read and accepted the Terms and Conditions, and complete payment. Pricing is at our discretion and is specified at the point of sale. You will not be deemed entered until your payment has cleared and we have confirmed your entry. Except as expressly provided in clause 23 or as required by law, once a Ticket has been used to enter a Prize Competition, no refund, credit or exchange shall be made in respect of it. The following restrictions apply to payments made by credit card: the total amount that may be spent using credit cards is limited to £250 (two hundred and fifty pounds) per calendar month per person, across all Competitions that we offer, and this restriction applies however the credit card payment is processed. The detection and classification of payment methods, including whether a card is a credit card, relies on information provided to us by our third-party payment service providers, and we apply the restriction to the best of our knowledge based on that information.
Free Postal Entry
7.5 You may enter any Prize Competition free of charge by post, with the same chance per entry of winning a prize as a paid Ticket. Other than the cost of ordinary first or second class postage, there is no requirement to pay to enter by the postal route.
7.6 To enter by post, you must send a clear handwritten postcard or letter (mechanically produced entries are not permitted), by first or second class post to Via del Premio Limited using the following address: 2 Plato Place, 72-74 St. Dionis Road, London SW6 4TU, and containing the following information: (i) full name, (ii) address (including city and postcode), (iii) phone number, (iv) registered email address for your VillaWin account, (v) name of the Competition you want to enter, and (vi) if applicable, your choice of prize from the selection available for the respective Competition in respect of Competitions where entrants must pre-select a prize.
7.7 You must have registered an account before sending your postal entry, and the details on the postcard must match the details on your account. A maximum of 1 (one) entry is permitted per letter or postcard; multiple letters or postcards sent in the same envelope will not be counted. You may send separately as many letters or postcards as you wish, up to the maximum number of entries permitted per person for that Prize Competition. We will allocate a number to each valid postal entry at random from the numbers available.
7.8 Postal entries must be received by us at least 24 (twenty-four) hours before the closing time stated on the relevant Competition page. All valid postal entries received by that time are entered into the draw for that Prize Competition, alongside the paid Tickets, and are not affected by the Prize Competition selling out. Any postal entry that does not comply with the requirements of this clause 7 will be void.
7.9 All letters and postcards are securely destroyed after processing. We cannot be held responsible for postal delivery times.
8. FREE COMPETITIONS
8.1 Free Competitions are promotional competitions which are exclusively free to enter. It is not possible to buy a Ticket for, or otherwise pay to enter, a Free Competition, and no payment or other financial commitment of any kind is required or accepted in connection with a Free Competition. Because participation is entirely free, the free postal entry route described in clause 7 does not apply to Free Competitions. We may run Free Competitions before, alongside or independently of any Prize Competition.
8.2 Entries into Free Competitions (‘Free Entries’) are awarded by us and cannot be bought. We may award Free Entries:
(a) where you complete a qualifying action, such as registering an account for the first time (including after scanning a promotional QR code at an event or in the materials of a promotional partner), referring a friend who genuinely registers an account (see clause 9), interacting with our social media or email promotions, completing a questionnaire or survey that we make available, redeeming a promotional or voucher code, or completing other activity on the Website; or
(b) as a prize or benefit won in another Free Competition, where the relevant Competition page so states. For the avoidance of doubt, Free Entries are not offered as prizes or benefits in Prize Competitions.
We reserve the right to define and adjust the qualifying actions and the number of Free Entries awarded for them at any time, and all current methods of obtaining Free Entries will be clearly communicated and made accessible to potential participants on the relevant Competition or promotion page.
8.3 You must have registered an account for a Free Entry to be awarded to you, and Free Entries are allocated to your account. We will send you an email confirmation of each confirmed entry into a Free Competition, and details of your Free Entries – including any expiry date and the Competition(s) for which they are valid – will be shown in your account.
8.4 Free Entries that expire unused simply lapse. Free Entries have no monetary value, are non-transferable, cannot be exchanged for cash, Tickets or any other benefit, and no refund, payment or compensation is due in respect of them. Free Entries obtained in breach of the Terms and Conditions (see clause 16) are void.
8.5 Each Free Competition runs for the promotion period specified on the relevant Competition page, which will state the closing date and time, the prize, the maximum number of entries permitted per person and the date of the draw. The closing of Free Competitions is governed by clause 11, and the draw and the winner-selection process by clause 12, in the same way as for Prize Competitions: the winner is determined entirely at random from all valid and eligible Free Entries.
8.6 The Promoter of every Free Competition is Via del Premio Limited, including where a Free Competition is promoted at an event or through the channels of a promotional partner (for example, a football club); promotional partners do not act as promoter and are not responsible for the Free Competition.
8.7 The eligibility requirements in clause 4 apply to Free Competitions in the same way as to Prize Competitions, and the winner of a Free Competition may be required to provide documentary evidence of their age and identity (including a copy of photo identification) before the prize is awarded, in accordance with clauses 4.1 and 12.
9. REFER A FRIEND
9.1 We may operate, from time to time, a referral programme allowing registered account holders (‘Referrers’) to invite friends to register with VillaWin (‘Referees’). A referral programme is available only when, and as, published on the Website; participation in, or rewards received under, one referral programme do not create any entitlement to participate in, or to receive rewards under, any future referral programme. When a referral programme is active, its details – including the reward, the qualifying period, any benefit for the Referee and any limits – will be published on the relevant promotion page of the Website. This clause 9 sets out the general rules that apply to every referral programme.
9.2 Each eligible Referrer will be provided with a unique referral link or referral code (‘Referral Link’). You may share your Referral Link personally with friends, family and acquaintances through lawful communication channels (for example, personal messages, email or your own social media accounts), provided that you comply with this clause 9.
9.3 A referral is a ‘Qualifying Referral’ only where all of the following conditions are met:
(a) the Referee is a new customer, who does not have and has not previously had a VillaWin account;
(b) the Referee registers an account using the Referral Link within the period stated on the relevant promotion page;
(c) the Referee meets the eligibility requirements in clause 4 and completes all registration and verification steps; and
(d) the referral does not, in our reasonable opinion, involve fraud, duplicate or linked accounts, self-referral or any other breach of the Terms and Conditions.
9.4 For each Qualifying Referral, the Referrer will receive 1 (one) Free Entry into the Supercar Free Competition, or such other Free Entry or reward as is stated on the relevant promotion page. Rewards are credited once the Referee’s account has been verified, and clause 8 applies to Free Entries awarded under this clause. Any benefit for the Referee will be as stated on the relevant promotion page.
9.5 Only referrals successfully recorded and tracked by our systems will count. We are not responsible for referrals that fail to register due to user error, ad blockers, browser settings or technical issues, and our system records are decisive as to the timing, tracking and verification of referrals.
9.6 When participating in a referral programme, you must not:
(a) use spam, unsolicited bulk messages or inaccurate or misleading methods to solicit referrals;
(b) post your Referral Link on commercial coupon, voucher-code or deals websites, or use paid advertising to promote it;
(c) use stolen or fake accounts, bots or automated scripts to generate referrals;
(d) self-refer (including under another identity or through another account) or otherwise manipulate the referral mechanism or its tracking;
(e) encourage, assist or induce any other person to breach this clause 9;
(f) promote your Referral Link outside the territories listed in clause 4.1, or in any jurisdiction where doing so would be unlawful;
(g) publish obscene, offensive, defamatory or otherwise unlawful content in promoting your Referral Link; or
(h) breach any applicable law, regulation or advertising rules.
9.7 We may limit the number of Qualifying Referrals that are counted for rewards (any limit will be stated on the relevant promotion page), and we may disqualify any participant, void their referrals and reclaim any rewards awarded where we reasonably believe that this clause 9 has been breached; clauses 5.3 and 16 apply. Rewards are personal to the Referrer’s verified account, are non-transferable and have no cash value; if the account is closed or suspended in accordance with the Terms and Conditions, pending and unused rewards will lapse.
9.8 We may amend, suspend or terminate any referral programme at any time, and we will try to provide prior notice where reasonably possible. Qualifying Referrals completed before any suspension or termination takes effect will be honoured.
10. MATCHDAY CHALLENGE
10.1 From time to time, we may publish free 'Matchday Challenge' rounds on the Website in connection with specified football or other sports matches (each a 'Round'). Each Round is a Free Competition: clause 8 applies to it except as varied by this clause 10, participation is free, and no payment or other financial commitment of any kind is required or accepted in order to take part or to win. Each Round is available only when, and as, published on the Website (see clause 2.2), opens when it is published and closes at the time stated on the relevant promotion page and, in any event, no later than the scheduled start of the relevant match.
10.2 To take part, you must have a registered account and, before the closing time, answer the questions about the relevant match published on the relevant promotion page, selecting one of the answer options given for each question. Unless the promotion page states otherwise, 1 (one) entry may be submitted per account for each Round, an entry must answer every question, and an entry is final once submitted.
10.3 Unless the relevant promotion page states otherwise, the questions in each Round relate to the relevant match at the end of regulation time (including any stoppage time added by the referee, and excluding extra time and penalty shoot-outs) and are settled on the result, events and statistics of the match as recorded at the end of the match by its official organiser or, where the promotion page names one, by the sports data provider named there. That record is decisive: no later amendment, annulment or forfeit of the result will affect the outcome of the Round and, if the record does not allow the correct answer to a question to be determined, we will, acting reasonably, either determine it or declare the question void and disregard it.
10.4 After the relevant match has finished, all entrants who answered all of the questions correctly will be entered into the promotional prize draw for that Round. The number of winners and the nature and number of prizes will always be stated on the relevant promotion page. The draw is governed by clause 12, save that each Round will have the number of winners stated on the promotion page, in place of the single winner referred to in clause 12.2. Prizes are governed by clause 13, and the announcement and publication of winners – including on our social media channels – by clause 15. Unless the relevant promotion page states otherwise, each winner receives 1 (one) prize and no entrant may win more than 1 (one) prize per Round. If no entrant answers all of the questions correctly, or if the relevant match is cancelled, abandoned or postponed beyond the period stated on the promotion page, no draw will take place and no prizes will be awarded for that Round, unless the relevant promotion page states otherwise.
11. CLOSING OF COMPETITIONS
11.1 Each Competition runs for the period specified on its Competition page, which will state the closing date and time of the Competition and the date on which the draw will take place. We will not cancel a Competition, reduce or substitute a prize, or change a closing date or draw date because of the number of entries received.
11.2 For Prize Competitions, online entries close at the earlier of: (a) the closing time stated on the relevant Competition page; and (b) the moment at which the last available Ticket is allocated (sell-out). Valid postal entries received in accordance with clause 7.8 are entered into the draw even where the Prize Competition sells out before the stated closing time, so a sell-out does not affect entrants using the free postal route. Free Competitions are not subject to sell-out, and Free Entries may be made or awarded until the closing time stated on the relevant Competition page. No further entries will be accepted after a Competition has closed.
11.3 We reserve the right, in our sole discretion, to extend, shorten, suspend, modify or cancel a Competition where, for any reason beyond our reasonable control, any aspect of the Competition is not capable of running as planned (for example, by reason of technical failure, tampering, fraud or any cause that affects the security, fairness or proper conduct of the Competition). In the event that we close a Competition early, the winner will be selected from all valid and eligible entries received by us before the date of closure.
12. THE DRAW AND THE WINNER
12.1 The winner of each Competition is determined entirely at random, in accordance with the laws of chance, from all valid and eligible entries, however they were made or obtained – paid online entries, free postal entries and Free Entries alike. The draw takes place on the date stated on the relevant Competition page and is conducted using certified random number generator software that produces verifiably random and auditable results, and may be live streamed on our social media channels. The random number generator will be operated across the full range of allocated entry numbers for the relevant Competition.
12.2 There will be 1 (one) first-prize winner per Competition. Some Competitions may also offer runner-up prizes, as specified on the relevant Competition page.
12.3 We will make reasonable attempts to contact the winner using the telephone number and email address held for their account. It is the entrant’s responsibility to keep their contact details up to date, and we will not be held responsible if they are recorded incorrectly.
12.4 If, for any reason: (a) we are unable to contact the winner within 5 (five) calendar days of the draw; (b) the winner fails to confirm acceptance of, or to claim, the prize within 30 (thirty) calendar days of the date on which we first contact them; or (c) the winner is disqualified for a breach of the Terms and Conditions, then (in each case as we may extend in our sole discretion) the winner will be deemed to have forfeited the prize and will have no claim in respect of it. In those circumstances we may, in our sole discretion, select an alternative winner from the valid and eligible entries, roll the prize over to a future Competition, or otherwise deal with the prize as we reasonably consider appropriate. We will not be liable to any person to whom a prize is incorrectly awarded as a result of incorrect contact details or a technical fault, and no compensation will be due.
12.5 We will use reasonable efforts to award each prize to the correct entrant. If, due to a technical, software, hardware or human error, a prize is awarded or delivered to the wrong person, we reserve the right to reclaim the prize and award it to the correct entrant, in our sole discretion and without admission of liability. If a prize is incorrectly delivered to you, you must promptly notify us, take reasonable care of the prize while it is in your possession, and return it to us (in the condition in which you received it) within 14 (fourteen) calendar days of receiving our return instructions; we will bear your reasonable return delivery costs.
13. PRIZES
13.1 Each prize is as described on the relevant Competition page and is owned by us from the date the Competition goes live until the prize is received by the winner. Once a winner has been verified and confirmed in accordance with clause 12, we will make arrangements for the delivery or collection of the prize; ownership of the prize passes to the winner when the prize is delivered to or collected by them. We will make each prize available for collection or delivery within 30 (thirty) calendar days of the date on which the winner is verified and confirmed, unless a different date or a longer period is stated on the relevant Competition page. We do not offer a cash alternative in place of a prize, unless the relevant Competition page or the applicable Promotional Terms expressly state that a cash alternative is available. Where a cash alternative is stated to be available, its amount (a fixed sum or a percentage of the recommended retail price of the prize) will be as stated on the relevant Competition page or Promotional Terms, and the winner may choose between the prize and the cash alternative within the acceptance window set out in clause 12.4; once confirmed to us, the winner’s choice is final.
13.2 Each prize is available for collection free of charge from a location specified by us. If the winner would prefer the prize to be delivered to their address, delivery will be arranged through our delivery partners and the associated delivery fee will be payable by the winner. This applies to all prizes, including vehicles (such as cars, motorcycles and vans).
13.3 Prizes (including vehicles) are made available for collection or delivery within the United Kingdom (including Northern Ireland), the Isle of Man and the Channel Islands only, and may not be exported outside those territories. If the winner is not located within one of those territories at the time of winning, it is the winner’s responsibility to provide an address within one of those territories for collection or delivery.
13.4 The winner is responsible for any and all taxes, fees and expenses relating to the acceptance, ownership or use of the prize. Each prize is subject to the terms and conditions of the relevant prize provider, manufacturer or supplier, is non-transferable, and cannot be exchanged or used in conjunction with any other voucher, offer or discount.
13.5 Where a prize is not capable of being delivered by standard courier, its collection or delivery will be arranged in accordance with clause 13.2: collection is free of charge from the location specified by us and, if the winner prefers delivery, the associated delivery fee is payable by the winner.
13.6 We do not insure a prize once it has been delivered or collected, and we accept no responsibility for a prize once it has been handed over to the winner. If, for reasons beyond our reasonable control, we are unable to provide the advertised prize, we reserve the right to provide a substitute prize of equal or greater value or, where a suitable substitute cannot reasonably be sourced, to pay the winner a cash amount equal to the recommended retail price of the advertised prize as displayed on the relevant Competition page.
13.7 Any cash prize or cash alternative will be paid by bank transfer within 21 (twenty-one) calendar days of our receipt of the winner’s bank details. Payments are made in pounds sterling (GBP). If the winner requests payment in another currency, the amount will be converted using the exchange rate applicable at the time of the transaction; exchange rates fluctuate, and any conversion or processing fees charged by payment providers or financial institutions will be borne by the winner.
14. PRIZES ON ASTON VILLA PREMISES
14.1 This clause 14 applies where a prize includes attendance at, access to or participation in any match, event, experience, hospitality or other activity taking place at Villa Park or any other premises owned, occupied or controlled by Aston Villa Football Club Limited or any of its group companies (an “Aston Villa Prize”).
14.2 Where an Aston Villa Prize includes attendance at a football match at Villa Park: (i) the relevant match will be the match specified on the relevant Competition page or otherwise notified to the winner; (ii) the date and kick-off time of the match may be changed or rescheduled; (iii) if the winner or any permitted guest is unable to attend the match on the date and at the time on which it takes place, including following any change or rescheduling, neither we nor Aston Villa shall be required to provide tickets for an alternative match, an alternative prize, a cash equivalent or any other compensation, although we or Aston Villa may elect to provide an alternative in our or its discretion; (iv) the winner and each guest must be an Aston Villa supporter or a neutral supporter and must not be a supporter of the opposition team; and (v) the winner and each guest must not wear or carry the colours, clothing, flags, merchandise or other branding of the opposition team or any football club other than Aston Villa.
14.3 Unless expressly stated otherwise on the relevant Competition page: (i) the winner and their guests are responsible for arranging and paying for their own travel to and from Villa Park or the relevant Aston Villa premises and for any accommodation, food, drink or other costs associated with attending or participating in the Aston Villa Prize; and (ii) the Aston Villa Prize is personal to the winner and may only be used by the winner and any guest or guests expressly permitted as part of the prize. It may not be sold, transferred, exchanged or otherwise disposed of.
14.4 Admission to and continued presence at Villa Park or any other Aston Villa premises is at all times subject to: (i) any applicable ticket conditions of issue, ground regulations and codes of conduct; (ii) any dress code or other requirements applicable to the relevant area, hospitality facility or experience; (iii) any security, safety, safeguarding or operational requirements imposed by Aston Villa; and (iv) any other terms or requirements notified to the winner in connection with the Aston Villa Prize. The applicable information and policies for Villa Park are available on Aston Villa's website at www.avfc.co.uk.
14.5 A person shall not be entitled to attend or participate in an Aston Villa Prize if they are, at the relevant time: (i) subject to a football banning order or any equivalent or similar order, restriction or sanction; (ii) banned or otherwise prohibited from attending Villa Park, Aston Villa matches or events; or (iii) otherwise prohibited by law, regulation or any applicable football authority rules from attending the relevant match or event.
14.6 Aston Villa may refuse admission to, remove from or require any person to leave Villa Park or other Aston Villa premises where that person: (i) does not satisfy the requirements of this clause 14; (ii) breaches any term, regulation or requirement referred to in clause 14.4; (iii) behaves in a manner which Aston Villa reasonably considers inappropriate, unsafe, disruptive, abusive or otherwise inconsistent with the standards reasonably expected of persons attending Villa Park or the relevant Aston Villa premises; or (iv) is otherwise liable to be refused admission or ejected under the applicable ground regulations or ticket conditions. Where admission is refused or a person is removed in accordance with this clause 14.6, neither we nor Aston Villa shall be required to provide any replacement or alternative prize or compensation.
14.7 Where an Aston Villa Prize includes an experience other than attendance at a football match, including attendance at another sporting event, concert, hospitality experience, tour, meet-and-greet or other event or activity, additional terms, eligibility criteria, age restrictions, timings, dress codes, security requirements or other conditions may apply. Any such requirements will be set out on the relevant Competition page or otherwise notified to the winner before participation.
14.8 The winner shall be responsible for ensuring that each of their guests complies with the requirements of this clause 14 and any other terms applicable to the Aston Villa Prize.
15. PUBLICITY
15.1 We may publish limited information to indicate that a valid prize was awarded for a Competition – for example, the winner’s name, county or country of residence, and a photograph – on the Website and our social media channels. We may invite (but will not require) winners to take part in reasonable publicity, including photographs and videos. If you do not wish your information to be published, please notify us in writing; you acknowledge that, even where you provide such notice, we may still be required to provide your details and winning entry to a regulator (including the Advertising Standards Authority) or to law enforcement on request.
15.2 For 1 (one) month after the end of each Competition, we will make available on request (by email to the address set out in clause 21) information indicating that a valid award took place, ordinarily the surname and county (or country) of residence of the winner. If you object to your surname and county being made available in this way, please tell us when claiming your prize; where you object, we may still be required to provide your details and winning entry to the Advertising Standards Authority or another regulator on request.
16. PROHIBITED CONDUCT
16.1 You acknowledge and accept that you will not: provide false, inaccurate or misleading information; open or use more than one account, or use another person’s account; use any bot, script, automated method, or VPN to disguise your location or to obtain more entries or Free Entries than permitted (including by opening multiple accounts or by performing qualifying actions that are not genuine, such as fabricated referrals); interrupt, interfere with, attack, or attempt to gain unauthorised access to the Website or our systems; or abuse or harass our staff or other customers. Any entries or Free Entries obtained in breach of this clause may be void, and where a prize has been won using such entries it may be withheld, voided and re-drawn.
17. OUR LIABILITY
17.1 Nothing in the Terms and Conditions shall exclude or limit our liability for: (i) death or personal injury resulting from our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded or limited as a matter of applicable law.
17.2 Subject to clause 17.1, we shall be liable for any loss or damage that is a reasonably foreseeable consequence of our breach of the Terms and Conditions or our negligence, but we shall not be liable for any loss or damage that is not reasonably foreseeable. We will not be liable for loss or damage caused by events beyond our reasonable control, by your misuse of the Services, or by any computer, network or software malfunction that is not caused by our failure to use reasonable skill and care.
17.3 Subject to clause 17.1, and except to the extent this would reduce your rights as a consumer below the level required by applicable law, our total liability to you in relation to any one incident or connected series of incidents shall be limited as follows: (a) where it relates to a prize you have won, to the value of that prize; (b) where it relates to the loss or deletion of, or a failure to process, your entry, to a replacement entry into another Competition or, where the entry was paid for, at your option, a refund of the price paid for that entry; and (c) in all other circumstances, to £100 (one hundred pounds).
17.4 Nothing in the Terms and Conditions affects your statutory rights as a consumer.
18. YOUR PERSONAL DATA
18.1 We will process your personal data in accordance with our Privacy Policy and our Cookie Policy, both of which are available on the Website. Please read them carefully, as they contain important information about how we use your personal data and about your rights.
19. COMPLAINTS
19.1If you have a complaint about any aspect of the Services, please contact us using the details in clause 21, and we will deal with your complaint promptly, in accordance with our Complaints Policy on the Website.
20. MINDFUL PLAY
20.1 We are committed to responsible participation. Information about the tools available to help you stay in control, and about where to obtain support, is set out in our Mindful Play Policy on the Website. You must be 18 (eighteen) or over to take part. The tools and measures we make available reflect our commitment to the standards of the Voluntary Code of Good Practice for Prize Draw Operators published by the UK Department for Culture, Media and Sport.

22. OTHER LEGAL TERMS
22.1 Governing law. The Terms and Conditions, and any dispute or claim arising out of or in connection with them or your participation in the Competitions (including non-contractual disputes or claims), are governed by, and shall be interpreted in accordance with, English law. If you are a consumer resident in Northern Ireland, the Isle of Man or the Channel Islands, you continue to benefit from any mandatory protections of the law of the place where you live, and nothing in this clause affects those rights.
22.2 Jurisdiction. You may bring proceedings in respect of the Terms and Conditions in the courts of England and Wales. If you are a consumer, you may also be entitled to bring proceedings in the courts of the place where you live, and nothing in this clause removes that right.
22.3 Assignment. We may transfer our rights and obligations under the Terms and Conditions to any person, in whole or in part; this will not affect your rights. You may not transfer your rights or obligations under the Terms and Conditions without our prior written consent.
22.4 Severability. If any provision of the Terms and Conditions is found to be unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
22.5 No waiver. Our failure or delay in exercising or enforcing any right or provision of the Terms and Conditions shall not operate as a waiver of that right or provision.
22.6 Entire agreement. The Terms and Conditions (and any documents, rules or policies incorporated by reference) constitute the entire agreement between you and us relating to the Services and supersede all prior arrangements. Section headings are for convenience only and have no legal effect.
22.7 Third parties. No person other than you and us shall have any right to enforce the Terms and Conditions.
23. REFUNDS
23.1 All entries are final and, except as set out in this clause, in clause 17.3(b) or as required by law, no refunds shall be made. We will refund an entry that was submitted after the relevant Competition had closed, or where we cancel a Competition before it is drawn. By entering a Prize Competition, you expressly request and consent to the immediate performance of the service by us – the allocation of your entry into the draw – and you acknowledge that, once your entry has been allocated into the draw, the service is fully performed and you lose the statutory 14 (fourteen) day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, save where required by law. Free Entries are awarded free of charge and have no monetary value; no refund, payment or compensation is due in respect of any Free Entry.
